Overview: This DMCA Policy outlines how USMC PFT Calculator handles copyright infringement claims under the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512. We take intellectual property rights seriously and respond promptly and in good faith to all valid copyright notices.

1

Overview & Our Commitment

USMC PFT Calculator is committed to respecting the intellectual property rights of others. We take copyright infringement seriously and have established clear procedures for handling DMCA notices in accordance with the safe harbor provisions of the Digital Millennium Copyright Act.

As a website that publishes original educational content about USMC fitness standards, we understand the importance of intellectual property protection — both for ourselves and for others. We do not tolerate the unauthorized use of copyrighted material on our platform.

Legal Basis: This policy is established pursuant to the Digital Millennium Copyright Act, 17 U.S.C. § 512 (the "DMCA"). The DMCA provides safe harbor protections to online service providers who comply with its notice and takedown procedures.

Our Position: We respect copyright law and will act expeditiously to remove or disable access to material that is claimed to be infringing upon receipt of a valid DMCA notice.

2

All original content published on USMC PFT Calculator is protected by copyright law. Unauthorized reproduction or distribution of our content is a violation of these rights.

  • The design, layout, graphics, color schemes, and visual elements of the website
  • Our PFT and CFT calculator interfaces, code, and scoring algorithm implementations
  • The USMC PFT Calculator brand name, logo, and overall site identity
  • All original images, illustrations, and custom graphics created for this website

Content in the Public Domain

The underlying USMC fitness standards referenced on this site (MCO 6100.13A and related Marine Corps Orders) are U.S. government documents in the public domain under 17 U.S.C. § 105. However, our original creative expression, editorial content, unique presentation, and calculator implementations of these standards remain our exclusive intellectual property.

Copyright Protection: Copying, scraping, or reproducing our original content without written permission may constitute copyright infringement and may result in legal action, including DMCA takedown requests against offending websites.

3

Reporting Copyright Infringement

If you believe that content published on USMC PFT Calculator infringes your copyright or the copyright of someone you are authorized to represent, you may submit a formal DMCA takedown notice to our designated copyright agent.

Before Filing: Please carefully review the content you believe is infringing. Consider whether it may qualify as fair use, commentary, criticism, or reference to public domain government documents. Not all uses of copyrighted material constitute infringement. Submitting a false or misleading DMCA notice may expose you to legal liability.

Who Can File a DMCA Notice

  • The copyright owner of the allegedly infringed work
  • An authorized legal representative acting on behalf of the copyright owner
  • An agent or attorney with documented authority to act for the rights holder

We cannot process DMCA notices from parties who do not own or are not authorized to act on behalf of the copyright in question.

4

5

⚠ Penalty of Perjury: By submitting a DMCA notice, you declare under penalty of perjury that the information in your notice is accurate and that you are the copyright owner or are authorized to act on behalf of the owner. Knowingly making false statements in a DMCA notice may subject you to civil and criminal liability.

  • A statement under penalty of perjury that you have a good faith belief the content was removed by mistake or misidentification
  • Your name, address, and telephone number

8

Repeat Infringer Policy

In accordance with 17 U.S.C. § 512(i), USMC PFT Calculator maintains a strict policy regarding repeat copyright infringers.

  • Users who repeatedly infringe third-party copyrights will have their access to this website terminated
  • We track and document all DMCA notices and the users associated with infringing content
  • A "repeat infringer" is any user who has had content removed following two or more valid DMCA notices
  • Termination of access for repeat infringers is implemented at our sole discretion
  • In egregious cases of infringement, we may take additional legal action

Zero Tolerance: We have a zero-tolerance policy for intentional, repeated copyright infringement. Repeat infringers will be permanently banned from USMC PFT Calculator and may be referred to appropriate legal authorities.

9

False Claims Warning

Filing a false or misleading DMCA notice is a serious legal matter. Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing — or that material was removed by mistake — may be subject to significant civil and criminal liability.

Potential Consequences of False Claims

  • Civil liability for damages, including costs and attorneys' fees incurred by the alleged infringer
  • Criminal penalties for perjury if the false statement was made under oath
  • Legal action by USMC PFT Calculator for abuse of the DMCA process
  • Reporting to relevant bar associations if filed by an attorney

Think Before Filing: If you are unsure whether content on our site constitutes infringement, we recommend consulting with a qualified intellectual property attorney before submitting a DMCA notice. We take false DMCA claims very seriously and will pursue all available legal remedies against bad-faith claimants.

10

Fair Use & Public Domain

Before filing a DMCA notice against content on USMC PFT Calculator, please consider whether the content may be protected by the fair use doctrine (17 U.S.C. § 107) or falls within the public domain.

Fair Use Factors We Consider

  • The purpose and character of the use (educational, non-commercial, transformative)
  • The nature of the copyrighted work
  • The amount and substantiality of the portion used relative to the whole work
  • The effect of the use upon the potential market for the original work

Public Domain Content

U.S. government works — including Marine Corps Orders, military regulations, and official government publications — are in the public domain under 17 U.S.C. § 105 and are not subject to copyright protection. Our reference to and discussion of these official documents does not constitute copyright infringement.

Educational Use: Much of our content constitutes fair use as it is educational, non-commercial, and does not substitute for or compete with the original work. We encourage you to carefully assess fair use before submitting a DMCA notice.
